When a Construction Site Injury Becomes a Third-Party Claim
A construction injury often looks like a compensacion laboral case first. You report it. Medical bills start. Wage benefits may follow. That system is no-fault as to your employer, and it is limited.
Sometimes the story is bigger than that. Another contractor created the hazard. A driver hit you next to the site. Defective equipment failed. In those situations Idaho law may allow a third-party claim on top of workers compensation.
The key word is "may." Not every other company on a job site is a defendant you can sue.
Workers compensation is usually the exclusive remedy against the employer
Idaho Code 72-209 says the employer's liability under the workers compensation law is exclusive, subject to 72-223. In most workplace injuries, you cannot bring an ordinary negligence lawsuit against your employer.
That is the trade. Benefits do not depend on proving your employer was at fault. In return, you generally do not get a full tort case against that employer.
We explained the broader split in Third-Party Claims vs Workers Comp in Idaho. This post is about when a construction injury actually crosses into a third-party case.
What Idaho Code 72-223 allows
Idaho Code 72-223(1) says the right to workers compensation is not affected when the injury, occupational disease, or death is caused under circumstances that create legal liability in some person other than the employer. That person is called the third party.
The employee may institute an action against that third party. If compensation has been claimed and awarded, the case can be brought by the employee and employer jointly, or by the employer in the employee's name if the employee refuses to participate.
If compensation has been claimed and awarded, the employer is subrogated to the employee's rights against the third party to the extent of the employer's compensation liability. In other words, benefits already paid are not ignored when a third-party recovery comes in.
Idaho Code 72-223(4) addresses how attorney fees and costs are shared from that recovery unless the parties agree otherwise, or unless listed exceptions apply.
Who is not a third party
This is where construction cases get oversold online.
The same statute says a third party shall not include those employers described in Idaho Code 72-216 who have contractors or subcontractors that have in fact complied with Idaho Code 72-301. It also shall not include the owner or lessee of premises, or another person who is virtually the proprietor or operator of the business there carried on, but who is not the direct employer of the workers because of an independent contractor or another reason.
On a crowded job site, that can keep some upstream companies inside the workers compensation exclusive-remedy world instead of in a civil courtroom. Idaho appellate cases have spent years drawing that line. It is fact-specific. A company with a different logo on its trucks is not automatically fair game.
Do not sign away a possible claim, and do not assume you have one, based on a blog post.
Situations that often deserve a closer look
These are examples of when a third-party investigation is worth doing. They are not a guarantee that a lawsuit exists.
- A driver who is not your employer hits you near the site
- A manufacturer or supplier provided equipment that failed
- Another company created a hazard it was supposed to control, and it is actually a third party under 72-223
- A property condition outside the exclusive-remedy net caused the fall or collapse
The investigation has to happen early. Site conditions change. Subcontractors leave. Photos and witness names disappear.
What to do after a construction injury
Get medical care. Report the injury. Follow the workers compensation process so benefits are not delayed.
Then get the third-party question checked before you give a recorded statement to every insurer on the project. Keep the names of companies on site, the general contractor, equipment brands, and anyone who saw what happened.

Preguntas Frecuentes
Can I sue my employer after a construction site injury in Idaho?
Usually no. Idaho Code 72-209 makes workers compensation the exclusive remedy against the employer in most cases. A separate civil claim is aimed at a third party, not at the employer who is paying, or should be paying, workers compensation benefits.
What is a third-party claim after a job injury?
Idaho Code 72-223 says workers compensation does not wipe out a legal claim against a person other than the employer who is liable for the injury. Typical examples can include a negligent driver, a product manufacturer, or another company on site that is actually a third party under the statute.
Is every other company on the job site a third party?
No. The statute says a third party does not include certain statutory employers described in Idaho Code 72-216 whose contractors complied with 72-301. It also does not include an owner or lessee of premises who is virtually the proprietor of the business but is not the direct employer. Those lines are fact-specific.
If I already claimed workers compensation, can I still bring a third-party case?
Yes, if a true third party exists. If compensation has been claimed and awarded, the employer or surety is subrogated to the rights of the worker against that third party to the extent of the compensation liability. Attorney fees and costs on the recovery are addressed in 72-223(4).
