How Long to File a Wrongful Death Claim in Idaho?

Idaho wrongful death filing deadline documents

After a preventable death, families are dealing with grief, funeral costs, and a pile of paperwork. The legal clock still runs. In Idaho, a wrongful death claim generally has to be filed within two years.

That is a short window when you are still trying to understand what happened. Evidence fades. Vehicles get repaired. Witnesses move. Insurers still work their files.

The two-year deadline

Idaho Code 5-219 covers actions for personal injuries and for death caused by a wrongful act or neglect. In ordinary negligence cases, families should plan around a two-year deadline from the date of death.

This article is about the civil claim. It is not a promise that every fact pattern uses the same start date. Some situations, including certain government claims, can be shorter. A lawyer needs the dates, the defendants, and the records before anyone should relax.

If you are past two years, do not assume there is nothing left to ask. There can be rare exceptions. Do not assume you have extra time either.

Who can file

Idaho Code 5-311 sets out who may bring a wrongful death action. In broad terms, that can include the surviving spouse, children, parents, other dependents, or the personal representative of the estate.

Not every relative has the same role. Adult siblings, for example, are not automatically in the same position as a spouse or a dependent child. The estate and the wrongful death claim can overlap in ways that need to be sorted out, especially when there are medical bills, life insurance questions, or more than one family member.

What the claim is actually for

A wrongful death claim is a civil case. It asks a court, or an insurer, to account for the family's losses when someone else's negligence caused a death.

That can include funeral expenses, lost financial support, and other damages Idaho law allows on the facts. It is not a criminal conviction. The civil case can proceed even if no one is charged, and it can proceed on a different timetable than a criminal case.

Why families lose time

People wait because they are exhausted. They wait because a police investigation is open. They wait because an insurance adjuster sounds helpful. They wait because they do not want to "make it about money."

The claim is how medical bills, lost income, and the hole in a household get addressed. The insurer already knows the deadline. You should too.

Practical next steps

  • Keep copies of the death certificate, crash report, and medical records you already have
  • Do not give a recorded statement to the other side's insurer before you talk to a lawyer
  • Write down names of witnesses and what they saw
  • Ask early if a government entity might be involved
  • Call before the two-year mark, not after

Frequently Asked Questions

How long do you have to file a wrongful death claim in Idaho?

Idaho generally gives two years for a wrongful death claim. Families should treat that as running from the date of death unless a lawyer confirms a different date based on the facts. Missing the deadline can end the civil claim.

Who can file a wrongful death claim in Idaho?

Under Idaho Code 5-311, the people who may bring a wrongful death claim include the surviving spouse, children, parents, other dependents, or the personal representative of the estate. Who has standing in a particular family depends on the facts.

Is the civil deadline the same as a criminal case?

No. A criminal prosecution, if there is one, is a separate process. Families should not wait for a criminal case to finish before asking about the civil deadline.

Can the deadline be shorter than two years?

Yes. Claims involving government entities can have shorter notice rules. Get the dates reviewed early if a public employee, public road, or public facility may be involved.
