Who Is Exempt From Workers Compensation in Idaho?

Not every job in Idaho sits inside the workers' compensation system. Idaho Code § 72-212 lists specific kinds of employment that can be exempt. People get this wrong in both directions. Some assume everyone is covered. Others assume a contract label like "independent contractor" ends the analysis.

Here is what the statute actually points to, in plain English.

Exemptions listed in Idaho Code § 72-212

Idaho Code § 72-212 includes categories such as:

  • Household domestic service
  • Casual employment
  • Employment of outworkers
  • Employment of members of an employer's family dwelling in the employer's household (subject to the statute's terms)
  • Employment as the sole proprietor, working partner of a partnership, member of an LLC, or a corporate officer or director owning 10% or more of corporate stock (as described in the statute)
  • Employment for which a rule of liability for workers' compensation benefits is provided by federal law
  • Employment of agricultural pilots flying crop-spraying aircraft, under the conditions set out in the statute
  • Employment of real estate brokers or salesmen paid only by commission
  • Employment of volunteer ski patrollers
  • Employment of secondary school athletic officials

Those categories are statutory. They are not a free-form "we prefer not to carry coverage" list.

Independent contractors are not automatically exempt

This is the mix-up that causes the most trouble. Calling someone an independent contractor does not automatically remove them from workers' compensation analysis in Idaho.

Courts and agencies look at the working relationship. A major factor is the right to control how the work gets done. Tools, schedule, supervision, method of payment, and whether the person is running a true independent business all matter. A signature on a contractor form is not the whole story.

Why exemption fights matter after an injury

If you get hurt and the other side says you were exempt, the immediate problems are practical:

  • Who pays the medical bills?
  • Is there wage replacement?
  • Is there a personal injury claim against someone else?
  • Was the business required to carry coverage and failed to do it?

Those questions turn on facts and statute, not on what sounded convenient at hiring.

What to do if coverage is disputed

  • Get medical care documented
  • Keep pay records, texts, schedules, and any contract
  • Write down who supervised the work and how
  • Do not assume a denial letter is the end of the claim
  • Talk with a lawyer before giving recorded statements about your "contractor" status
